PATRIMONIO LR I, Sociedad Anónima de Capital Variable, hereinafter “ALMA VIVA” or the “Responsible”, indistinctly one from the other, is a legal company constituted under the law of Mexico, duly registered in the Federal Taxpayers Registry under the code PLI190524SIA.
ALMA VIVA, in compliance with articles 3 section I, 15, 16 and 17 of the Federal Law on protection of Personal Data held by Individuals, hereinafter the “Law”, is responsible for the use and protection of the personal data of its customers and of the natural and legal persons, with whom it has a business relationship, suppliers, service providers, commercial allies, and any other natural or legal person, who contact it, hereinafter they will be called the “Users”. The use and protection of data will be made following the principles of legality, consent, information, purpose, loyalty, proportionality and responsibility, for this reason, informs the following:
That in accordance with the Law and with this Privacy Notice, ALMA VIVA may request, collect, or store personal information of Users and Customers, being but not limited to: names, surnames, denominations and corporate reasons, address, occupation, gender, email address, mobile and landline telephone numbers, city, state and country of residence, bank account numbers, interbank keys, legal documents that prove the personality of their legal representatives or natural persons, autograph signatures, taxpayers ID, immigration information, marital status, marriage certificate, among others necessary for ALMA VIVA to comply with Users, whatever their nature, the development of its services.
ALMA VIVA by means of this act undertakes not to disclose the personal data of the Users, unless it has the authorization of the Same Users or that the respective authorities request to make such data available. Additionally, it will be authorized to display the personal information of Users in case of legal requirement by competent authority, in accordance with the provisions of the Federal Law for the Prevention and Identification of Operations with Resources of Illicit Origin (LFPIORPI).
The personal data referred to in this Privacy Notice may be collected by ALMA VIVA when they are provided directly by Users at the offices of ALMA VIVA, when they are necessary to formalize the contractual relationship between them, in the purchase and sale of investment lots, in the contracts, agreements and commercial agreements that it celebrates, as well as to execute the services that are contracted, or when by the nature of their business they have the need to treat and / or use their personal data, so among the ways in which ALMA VIVA will obtain your personal data are, direct contact with ALMA VIVA or, where appropriate, when contact is made through its website www.almaviva.mx , by telephone, text messages and / or whatsapp to the number 999 161 8145, or by emails to the address contacto@almaviva.mx or others, through their commercial and strategic allies, as well as through any necessary and convenient means between Users and ALMA VIVA.

Personal data subject to treatment.– The personal data of the Users that will be subjected to treatment for the use of ALMA VIVA are: names, surnames, denominations and corporate names, address, occupation, gender, email address, mobile and landline telephone numbers, city, state and country of residence, bank account numbers, interbank keys, legal documents that prove the personality of their legal representatives or persons physical, autograph signatures, taxpayers ID, immigration information, marital status, marriage certificate, among others. In the case of financial information, bank account numbers, and interbank keys, if applicable, ALMA VIVA will explain with all certainty and clarity to the Users, the reason for their request, as well as the scope of the request for such personal data. ALMA VIVA for no reason will request information considered sensitive such as that relating to religion, state of health, sexual preference or political preference, since they are not part of the data necessary for the development of its object, however, if it were to request them, it will fully explain to the User, the reason for its request, as well as the treatment that will be given to them.
Purpose of processing personal data. – Personal data will be treated in accordance with the following purposes:
1. As a main purpose, for the formalization of contracts and to carry out the purchase and / or sale of investment lots;
2. As secondary purposes, to follow up with customers, create their digital files, service surveys, mailings and advertising, among others.
Users may request ALMA VIVA, by sending mail to contacto@almaviva.mx, that their personal data are not used for secondary purposes. ALMA VIVA must respond to this request from 24 to 72 hours after receiving the request, in which case, it will be limited to the use of your personal data for the main purpose.
Options and means that the Responsible offers to limit the use or disclosure of personal data.- ALMA VIVA will protect the personal data of the Users inside computer programs with limited access through the use of passwords, as well as in files for the case of personal data contained in physical documents, which will only be available to the staff of ALMA VIVA which has been duly authorised for that purpose. The security of the information of the Users is a priority for ALMA VIVA, that is why the information will be protected through the use, application and maintenance of technical and administrative security measures.
ALMA VIVA has implemented internal policies and processes applicable to its staff, through which personal data are used by a minimum of people, limiting the use of the means of reproduction and generating the obligation to destroy all copies or reproductions of documents that contain personal data that are not strictly indispensable. The persons authorized to handle your personal data will be the operational staff of the sales area and the marketing area of ALMA VIVA and the persons or companies with which the responsible has strategic alliances. Regarding the personnel of ALMA VIVA and its strategic allies, ALMA VIVA undertakes, as an indication of goodwill in the handling of your personal data, to enter into confidentiality agreements with each of these agents, ensuring the privacy and protection of your personal data.
ALMA VIVA, will not be responsible for the illegal interception of communications by third parties. In the event that ALMA VIVA becomes aware of such circumstance, Users will be notified by any means so that the measures considered pertinent to safeguard their data are taken.
ALMA VIVA states that it may make transfers of personal data of users or customers, which will be national, and will be made with the strategic allies that require it. The purposes of the data transfer are commercial, advertising and promotion In case of transmission to third parties, the rights will be in force and will be mandatory for third parties to whom, where appropriate, the personal database is transmitted. ALMA VIVA undertakes to carry out all the necessary steps so that the security measures on the data contained in the system are not altered when the aforementioned data transfer is made; and to ensure that the third parties acquiring the personal database of the Users are obliged in the terms established in the Privacy Notice.
Means to exercise the rights of Access, Rectification, Cancellation or Opposition (ARCO). Users may at any time exercise their rights of access, rectification, cancellation or opposition by submitting a request in terms of Chapter IV of the Federal Law on protection of Personal Data Held by Individuals, by writing to the Responsible with attention to the Sales Department or, where appropriate, to the person in charge of customer service, sent to the email contacto@almaviva.mx, a request that must be met within 24 to 72 hours, extendable in terms of law, counted from the date of receipt of the request, with acknowledgment of receipt, issuing the corresponding determination for the legal effects to which there is place. Notices made by any other means are not valid.
The revocation of consent may be made in the same terms of the previous paragraph, through the respective cancellation request.
Changes to the Privacy Notice. In the event that ALMA VIVA requires to modify the content of this Privacy Notice, it reserves the right to change, modify, complement and / or alter this Privacy Notice, at any time, in which case it will be made known to users no later than 3 days after the modifications are made, through the website www.almaviva.mx , and physically in offices and work centers, making available the new Privacy Notice, applying the provisions of the Law itself, for the manifestation of the will of the Users. All modifications made to this Notice will take effect 30 days after its publication on its website if applicable and physically in its offices and workplaces.
